PUZS is, in the sense of the General Data Protection Regulation (Regulation (EU) 2016/679), the controller of your personal data, ie it collects, stores and uses (and otherwise processes) your personal data for the performance of its business activities (individual purposes for which personal data are processed are defined in more detail below).

This Privacy Policy applies to:

1. processing of personal data by PUZS during the performance of contracts with business partners,
2. processing of personal data of seconded staff,
3. processing of personal data for the purpose of sending business messages and targeting advertising,
4. processing of personal data by PUZS during your use of the website operated by PUZS (“Website”).

The principles of personal data processing describe the purposes of personal data processing and methods of their processing, inform about individual categories of processed personal data, their potential recipients, retention period of personal data and your rights in relation to personal data protection.

PURPOSES OF PERSONAL DATA PROCESSING

Your personal data may be processed by PUZS for the following purposes:

• Protection of the legitimate interest of the administrator (protection of the rights and legally protected interests of PUZS, for example, protection of the Website and PUZS network against misuse, operation of the camera system in stores, production plant and e-shop);
• Handling requests received by e-mail;
• Sending business messages (newsletter) and targeting advertising.

PERSONAL DATA PROCESSED

PUZS is entitled to process the following personal data according to the purpose of processing:

Personal data is processed both manually and automatically. The automated processing of personal data takes place for the purposes of fulfilling the contract, in particular to ensure the internal processes within the PUZS, which are necessary to ensure the production, distribution and delivery of goods and the provision of related services. Automated processing of personal data also occurs in cases of consent to the sending of marketing messages and advertising targeting.

PROCESSING OF PERSONAL DATA BASED ON CONSENT

If you give PUZS consent to the processing of personal data for the purpose of sending commercial messages and targeting advertising, you acknowledge that the provision of consent is voluntary and that the consent can be revoked at any time. Consent is provided (i) in the case of the Loyalty Program for the period of participation in the Loyalty Program or until its revocation (ii) in other cases for a period of 5 years or until its revocation.

RECIPIENTS OF PERSONAL DATA

At PUZS, your personal data is made available only to authorized employees, or to individual processors of personal data contractually agreed to PUZS, or to other administrators. These are, for example, processors or administrators involved in the delivery of goods / services, the execution of payments, the provision of services in connection with the operation of an e-shop or the provision of marketing services. However, always only to the extent necessary for the fulfillment of the individual purposes of processing, and on the basis of the appropriate legal title for the processing of personal data. PUZS is entitled, resp. obliged to transfer certain personal data on the basis of valid legal regulations, for example to bodies active in criminal proceedings or other public authorities.

PERSONAL INFORMATION OF THIRD PARTIES

Personal data of third parties, which means personal data of employees of PUZS’s business partners, carriers and other natural persons involved in cooperation with PUZS, or other data that PUZS receives from the business partner in connection with the conclusion or performance of the contract will be processed in accordance with applicable legislation in the field of personal data protection. This personal data will be used by PUZS for the purpose of fulfilling contracts with business partners. The Business Partner hereby acknowledges that the PUZS will process personal data of third parties for the duration of the contractual relationship and for the period specified by special legal regulations, if any. They will then be kept for a longer period if, in a justified case, the need arises to keep data in connection with a specific case. The business partner is obliged to properly instruct its employees and other natural persons participating on the part of the business partner in cooperation with PUZS about the processing of personal data by PUZS.

PERSONAL DATA RETENTION PERIOD

We process and store your personal data for the time necessary to ensure all rights and obligations arising from the relevant contractual relationship and for the period during which PUZS is obliged as a personal data controller to store personal data in accordance with generally binding legal regulations or for which you processing have given their consent. In other cases, the processing time stems from the purpose of the processing, which must be proportionate or given by personal data protection legislation.

* PUZS is entitled to process your e-mail address in the sense of § 7 paragraph 3 of Act No. 480/2004 Coll., On certain information society services and on the amendment of certain acts (Act on certain information society services), as amended, for for the purpose of disseminating commercial communications concerning your own products or services (eg in the form of a newsletter) if you have not refused such sending.

RIGHTS OF DATA SUBJECTS

As a data subject, you have the rights below which you have under the law and which you can exercise at any time. This is the right (i) to access personal data, (ii) to correct inaccurate or false personal data, (iii) to delete personal data if the personal data are no longer needed for the purposes for which they were collected or otherwise processed, or if it is found that they have been processed illegally, (iv) to limit the processing of personal data, (v) to the portability of the data and (vi) the right to object, after which the processing of your personal data will be terminated, unless it is proven that there are serious legitimate reasons for the processing which outweigh the interests or rights and freedoms of the data subject, in particular where the reason is any enforcement of legal claims. PUZS will carry out the repair without undue delay, taking into account the technical possibilities.
• Right of deletion: if you request deletion, PUZS will delete your personal data if (i) they are no longer needed for the purposes for which they were collected or otherwise processed, (ii) the processing is illegal, (iii) you object to the processing and there are no overriding legitimate reasons for processing, or (iv) the processing of the PUZS does not impose a legal obligation.
• Right to restrict the processing of personal data: if you are not interested in deleting, but only temporarily restricting the processing of your personal data, you can request a restriction on the processing of your personal data from PUZS.
• Right to data transferability: in case you want PUZS to transfer your personal data, which it processes on the basis of your consent or on the basis of a contract, to a third party, you can exercise your right to data transferability. If PUZS does not prove that there is a serious legitimate reason for processing that outweighs your interests or rights and freedoms, it will terminate processing on your basis without undue delay. If the main substance of your objection is against sending commercial messages and targeting advertising, please use the link at the end of the last commercial message (newsletter) you received from us to unsubscribe from receiving commercial messages and processing personal data for this purpose.

In the case of repeated or manifestly unfounded requests for the exercise of the above rights, we will be entitled to charge a reasonable fee for the exercise of the right, or we will refuse to exercise it. We would inform you about such a procedure.

EXTRAORDINARY DISPUTE RESOLUTION

The customer has the right to out-of-court settlement of any disputes under the contract with the seller in accordance with § 20d et seq. Act No. 634/1992 Coll., on consumer protection, as amended, through the Czech Trade Inspection Authority ( www.coi.cz ).

This policy of personal data processing is effective from 5.5.2022.
